Terms of Service
These terms govern your use of the Horient mobile app, the horient.app website, and related services (together, the "Service"). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.
These terms are an agreement between you and Horient LTD. (赫里恩有限公司), a limited company registered in Taiwan, Republic of China (Company No. 統一編號 62161557), registered office in Keelung City 201003, Taiwan. “We”, “us” and “Horient” mean that company.
1. The Service — and its limits
Horient provides communication, location-sharing, navigation display and safety-alert features for travelers, sailors, aviators and explorers.
Horient is not an emergency service and is not a certified navigation instrument.Location, heading, speed, altitude, weather, star positions and traffic data (AIS/ADS-B) are estimates from your device's sensors and third-party data sources; they can be wrong, delayed or unavailable — especially offshore or in the air. SOS alerts reach only the personal contacts you designated, only while devices and networks cooperate; they do not contact coast guard, air traffic control, police or any rescue authority. Never rely on Horient as your only means of navigation, communication or distress signalling. Carry and use the certified equipment (VHF/DSC radio, EPIRB/PLB, transponder) your activity requires.
2. Your account
- You must be at least 13 years old (or the digital-consent age in your country).
- You are responsible for your device and credentials. End-to-end encryption keys live on your devices; if you lose all devices and your recovery backup, we cannot recover your encrypted messages — by design.
- One account per person; no automated or resold accounts.
3. Acceptable use
You agree not to:
- harass, threaten or defraud other users, or send spam;
- publish unlawful content in public areas (pins, discovery posts, the marketplace) — public content is moderated and may be removed;
- misuse SOS or safety features for false alarms or pranks;
- track a person without their knowledge and consent — location sharing in Horient is consent-based by design, and circumventing that is grounds for immediate termination;
- probe, overload or reverse-engineer the Service, or use it to build a competing dataset.
4. Your content
You keep ownership of what you create. For content you choose to publish publicly (pins, posts, marketplace listings), you grant us a non-exclusive licence to host and display it within the Service. Encrypted private content is yours alone — we hold only ciphertext we cannot read. Marketplace ("Deal Market") posts are user-generated: transactions happen between users, and we are not a party to them.
5. Subscriptions & purchases
- Optional subscriptions (e.g. Helm Pro) are billed through your Apple App Store or Google Play account at the price shown before purchase.
- Auto-renewal: subscriptions renew automatically until cancelled. Cancel anytime in your App Store / Play subscription settings; access continues to the end of the paid period.
- Free-trial periods, where offered, convert to a paid subscription unless cancelled before the trial ends.
- Refunds are handled by Apple/Google under their policies; we cannot issue store refunds directly.
- Prices may change; changes apply from your next renewal and never retroactively.
6. Third-party data & services
Maps, weather, ship (AIS) and aircraft (ADS-B) data, media transport and AI features rely on third-party providers and open data sources. Their availability and accuracy are not guaranteed, and their outages are outside our control.
7. Termination
You can stop using the Service and request account deletion at any time (see the Privacy Policy). We may suspend or terminate accounts that violate these terms, abuse safety systems, or create legal or security risk — with notice where practicable.
8. Disclaimers & liability
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss, injury or damage arising from reliance on the Service for navigation, communication or emergency response (see Section 1). Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights that consumer law gives you and that cannot be waived.
9. Changes to these terms
We may update these terms; the date above always reflects the current version. Material changes will be announced in the app before they take effect. Continued use after the effective date is acceptance.
10. Governing law & contact
These terms are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-law rules, and disputes belong to the courts of Taiwan unless mandatory consumer law says otherwise. Questions: support@horient.app
